Terms of use

Last updated 8 November 2026

1. Who these terms are with

These terms are an agreement between you and TeraShift GmbH, Switzerland ("we", "us"). They apply to the Break Reminder app for Windows ("the app"). You accept them when you agree on the app's first screen. If you don't accept them, choose "No thanks, quit" and uninstall the app.

2. Licence

We grant you a personal, non-exclusive, non-transferable and revocable licence to install and use the app on devices you own or control, free of charge, for as long as it remains installed. You may not:

  • copy, sell, rent, redistribute or sublicense the app, or offer it for download from anywhere other than this website,
  • modify, decompile or reverse engineer it, except where the law expressly allows it,
  • remove or work around the consent screen or the bandwidth-sharing component, or use the app without it.

The app includes open-source components under their own licences. They remain the property of their authors.

3. Bandwidth sharing

The app is free because it shares a small part of your unused internet bandwidth through EarnFM, a network we operate. By agreeing, you allow the app to:

  • download, run and update EarnFM's sharing component on your PC,
  • use spare bandwidth of your internet connection, while the app is running, to relay requests to public websites on behalf of EarnFM's business customers. Those websites see your IP address.

You confirm that:

  • you are of legal age where you live,
  • you own the device or have the owner's permission, and you are allowed to share the internet connection it uses. On a work, school or shared network, ask whoever runs it first,
  • sharing does not break the terms of your internet provider. If your connection is metered or mobile, sharing may use data that you pay for.

We don't pay you for sharing. The free app is what you receive in return. We may change, pause or stop the sharing at any time.

You can stop sharing at any time by uninstalling the app. Quitting the app also stops sharing until the app starts again.

How we handle data for sharing is explained in the privacy policy.

4. Acceptable use

You may not use the app or the sharing component to:

  • break the law or anyone's rights,
  • intercept, read, change or redirect traffic relayed through your connection,
  • tamper with the sharing component, fake devices or consent, or inflate or misreport shared bandwidth,
  • run the app on devices or networks you aren't allowed to use.

EarnFM's business customers must use the network lawfully and only to reach public web content. We review business customers before they get access and may block any use that breaks these rules.

5. Updates

The app updates itself: it downloads new versions in the background and installs them when you are away from the PC, then starts again in the tray. If a new version changes what is shared, the app asks for your consent again.

6. No warranty

The app is free and provided "as is". We work to keep it useful and reliable, but we don't promise that it is free of errors or always available, or that its information (for example battery readings or time calculations) is complete and correct.

7. Liability

As far as the law allows, we are not liable for damage caused by using the app or the sharing component, including lost data, lost profit or extra costs for internet use. This does not limit liability for damage we cause intentionally or through gross negligence, for injury to life, body or health, or under mandatory product liability or consumer protection law.

8. Ending this agreement

You can end this agreement at any time by uninstalling the app. We can end it, or your use of the sharing network, at any time, for example if you break these terms. Sections 4, 6, 7 and 9 continue after the end.

9. Law and courts

These terms are governed by Swiss law, without its conflict-of-law rules and without the UN Convention on Contracts for the International Sale of Goods. The courts of the Canton of Thurgau, Switzerland, have exclusive jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may also go to court there.

10. Changes to these terms

We may update these terms. The date at the top shows the current version. If a change affects bandwidth sharing, the app asks for your consent again.
